01 About these terms

These Terms and Conditions (Terms) are an agreement between you and AcademicID (ACN 660 800 377) ("we", "us", "our"). They govern your access to and use of this website and the Sapien waitlist. By accessing the site or submitting the waitlist form, you accept these Terms. If you do not agree, please do not use the site.

02 Scope & other agreements

This website currently provides information about Sapien and lets you join a waitlist. These Terms cover that use. They do not by themselves grant a licence to use the Sapien application.

  • Hosted Sapien (for example at academicid.io) will be provided under a separate service agreement presented when that service becomes available.
  • Self-hosted Sapien is provided as software under the open-source licence in its code repository.
  • Enterprise deployments are provided under a separate written agreement with your organisation.

Where another agreement applies to a deployment, that agreement prevails over these Terms to the extent of any inconsistency for that deployment.

03 Eligibility

You must be at least 16 years old and able to form a binding contract to use this site. If you use the site on behalf of an organisation, you confirm you are authorised to do so on its behalf.

04 The waitlist

  • Joining the waitlist registers your interest. It does not guarantee access to Sapien, a place in any program, pricing, or a launch date.
  • We may change, pause, or discontinue the waitlist or the Sapien roadmap at any time, and we are under no obligation to release any particular feature or service.
  • You agree to provide accurate information and to keep it up to date, and not to submit another person's details without their permission.

05 Acceptable use

When using this site, you must not:

  • break any applicable law, or infringe anyone's rights;
  • submit false, misleading, or another person's information, or spam, scrape, or abuse the waitlist or forms;
  • attempt to gain unauthorised access to, disrupt, overload, or probe the site or its infrastructure (including via automated requests or denial-of-service activity); or
  • introduce malware or interfere with the site's security features.

06 Intellectual property

The content of this website — including text, design, graphics, and the Sapien and AcademicID names and logos — is owned by us or our licensors and is protected by intellectual property laws. You may view and share this website for personal, non-commercial, informational use. You must not otherwise copy, reproduce, modify, or use our branding without our prior written permission. The Sapien application software is licensed separately (see below).

07 Open-source software

Sapien application software is made available as open source via our code repository. Your use, copying, modification, and distribution of that software is governed by the open-source licence included with it. Open-source software is provided "as is", without warranties, to the extent permitted by that licence and by law.

08 Generative AI use

Sapien includes generative AI features. If you use them (in this website's context or in the application), you agree to use them responsibly:

  • Academic integrity: do not use AI to plagiarise, fabricate, or otherwise breach the integrity policies of your institution, publisher, or funder.
  • Verify outputs: AI output can be inaccurate, incomplete, or biased. You are responsible for checking and validating any output before relying on it. AI output is not professional, legal, medical, or financial advice.
  • Ethical & lawful use: do not use AI features to create unlawful, harmful, infringing, or deceptive content.
  • Transparency: disclose AI assistance where your context (such as academic or professional publishing) requires it.

You are responsible for the inputs you provide and the use you make of any outputs.

09 Third-party services

Sapien can connect to third-party services, including AI model providers, storage, and reference tools that you or your organisation choose to configure. Those services are governed by their own terms, and we are not responsible for them. Links to third-party sites are provided for convenience and are not an endorsement.

10 Privacy

Our handling of personal information is described in our Privacy Policy, which forms part of these Terms. By using the site, you consent to that handling.

11 Disclaimers

The website and waitlist are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we make no warranties that the site will be uninterrupted, error-free, or secure, or that any roadmap, timing, or feature described will be delivered.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you may have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or other law that cannot lawfully be excluded.

12 Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, or consequential loss, or any loss of profits, data, or goodwill, arising out of or in connection with your use of this website or waitlist.

Where our liability cannot be excluded but can be limited, our liability is limited (at our option) to re-supplying the relevant service or paying the cost of having it re-supplied. Because access to this website and waitlist is provided free of charge, our total aggregate liability to you in connection with them is limited to AUD $100.

13 Indemnity

You agree to indemnify us against any reasonable loss, damage, cost, or expense we suffer arising from your breach of these Terms or your misuse of the website, except to the extent caused by us.

14 Changes

We may update these Terms or change or discontinue the website at any time. The current version will be posted on this page with its "last updated" date. Material changes will be made clear, and your continued use of the site after a change means you accept the updated Terms.

15 Governing law

These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia, and courts that may hear appeals from them. If any provision of these Terms is found to be unenforceable, the remaining provisions continue in force.
